On the advice of Education Minister Siddhartha Shankar Ray and leading lawyers of the Supreme Court, it was decided to impose a state of emergency under Article 352 of the Constitution. After this decision, the then President Fakhruddin Ali Ahmed was signed at 12 o’clock in the night and the arrest of the opposition leaders started in the night itself. The background of this was that the youth of the country did not accept that he should remain on the post of Prime Minister, whose election has been canceled by the High Court. The leader of this movement was Jayaprakash Narayan and he challenged Indira Gandhi. This was the reason that the leaders of the opposition Atal Bihari Vajpayee, LK Advani, Arun Jaitley, George Fernandez were arrested and put in jail. Article 19 and 21 were both suspended. Therefore, the arrest of any leader could not be challenged by writ in the High Court.
